1. Introduction
These Terms and Conditions govern your use of the WindkZone website and all associated services. By accessing or using WindkZone, you agree to be bound by these terms. If you do not agree to these terms, you must not use our services. WindkZone is operated by WindkZone Ltd, a company registered in England and Wales.
2. Eligibility
To participate in any WindkZone competition, you must be at least 18 years of age and a resident of the Denmark or any other jurisdiction where participation is not prohibited by law. We reserve the right to verify your age and identity at any time. WindkZone employees and their immediate families are not eligible to enter competitions.
3. Competition Entry
All competitions hosted by WindkZone are skill-based competitions. Entries are made by purchasing tickets and completing the Spot The Ball game. Each ticket entitles you to one entry into the relevant competition. The price of each ticket is displayed on the competition page. All payments are processed securely through our payment partners.
4. Prize Selection & Delivery
Winners may choose between the advertised prize or a cash alternative where stated. Prize delivery will be arranged within 28 days of the winner being confirmed. All prizes are subject to availability. In the unlikely event a prize is unavailable, WindkZone reserves the right to offer a prize of equal or greater value, or the cash alternative.
5. Winner Selection
Winners are determined by a panel of independent judges who decide the correct position of the centre of the ball in the Spot The Ball image. The entrant whose entry is closest to the judges' position wins the prize. All judging sessions are filmed and conducted in the presence of an independent legal representative to ensure transparency and fairness.
6. Intellectual Property
All content on the WindkZone website, including but not limited to text, graphics, logos, images, and software, is the property of WindkZone Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.
7. Limitation of Liability
WindkZone shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or participation in any competition. Our total liability to you for any claim shall not exceed the amount paid by you for the relevant competition entry. Nothing in these terms excludes liability for death or personal injury caused by negligence.
8. Modifications
WindkZone reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on the website. Your continued use of the website after any changes constitutes your acceptance of the modified terms. We recommend reviewing these terms regularly.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
